Background
Employment-related civil rights claims can be costly and disruptive, even when they lack merit. We represented employers in two recent matters—one in Massachusetts and one in New Hampshire.
In Massachusetts, a former employee alleged disability discrimination and retaliation after being terminated for non-performance.
In New Hampshire, another employee brought seven separate discrimination claims along with a retaliation claim.
Key Issues
Both employers faced potentially expensive and disruptive legal proceedings based on claims they believed were unfounded.
Resolution
In both matters, we gathered and presented detailed documentary and testimonial evidence, including emails, texts, and statements from coworkers and HR personnel.
- In Massachusetts, the Commission Against Discrimination dismissed the claims for lack of probable cause.
- In New Hampshire, the Human Rights Commission dismissed every claim for lack of probable cause.
These outcomes helped the employers avoid the significant financial and operational impacts such claims can cause, if not promptly and properly defended.
