We are very happy to share our Unanimous Landmark Victory at Massachusetts Supreme Judicial Court in Wage Act Law. We are proud of this example, in which we stood by our client and ”stuck to our guns,” against formidable Opposition to reverse a superior court’s decision regarding the measure of statutory damages for an employee who had not been properly paid. The decision reversed nearly twenty years of uncertainty within the state courts as well as the federal courts within the First Circuit.

Most importantly, the decision has made clear the measure of damages for employees within the Commonwealth of Massachusetts who have not been paid all their wages, including vacation, commissions, or paid time off, in full or on time. It has also provided bright line direction for employers as to what to do prior to officially terminating employees.
